Portugal Arbitration

Portugal is a Contracting State to the ICSID Convention:

• Signature: 4 August 1983 
• Deposit of Ratification: 2 July 1984 
• Entry into Force: 1 August 1984
• On 24 July 1996, pursuant to Article 25(3) of the ICSID Convention, Portugal designated 1 consituent subdivision/agency as compentant to be a party to an ICSID arbitration: 1) Investimentos, Comercio e Turismo de Portugal *On making the designation, Portugal also notified ICSID, that Portuguese approval would not be required for consents by Investimentos, Comercio e Turismo de Portugal to submit disputes to ICSID.
• Pursuant to Article 54(2) of the ICSID Convention, Portugal has designated “Supremo Tribunal de Justiça” as competent for the recognition and enforcement of ICSID awards.
• Pursuant to Article 69 of the ICSID Convention, Portugal enacted the Decree-Law No. 15/84 (Off. Gaz. No. 79, April 3, 1984); Romania Decret al Consillului de Stat privind ratificarea Conventici pentru reglementar differend relative la investitii intre State si persoane ale allor State, in cheiata la Washington la 18 martie 1965 (Off. Gaz. 56 June 7, 1975, p. 3) to make the Convention effective in their jurisdiction.
• Pursuant to Article 13(1) of the ICSID Convention Portugal has made the following panel designations effective until 16 March 2017:
  - Prof. José Manuel RIBEIRO SÉRVULO CORREIA: Professor of Law Emeritus, Faculty of Law, University of Lisbon
  - Mr. Miguel GALVÂO TELES: Attorney-at-Law
  - Mr. José Miguel JÚDICE: Attorney-at-Law
  - Mr. Agostinho MIRANDA: Attorney-at-Law
  - Prof. Dr. Dário MOURA VICENTE: Professor of Law, Faculty of Law, University of Lisbon

Portugal is a Contracting State to the New York Convention:

• Portugal will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state
