 New Zealand Arbitration

New Zealand is a Contracting State to the ICSID Convention:

  • Signature: 2 September 1970
  • Deposit of Ratification: 2 April 1980
  • Entry into Force: 2 May 1980
  • Article 70 - Notice of Exclusion (2 April 1980): Cook Islands, Niue, Tokelau
  • Pursuant to Article 54(2) of the ICSID Convention, New Zealand has designated “High Court” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 69 of the ICSID Convention, New Zealand enacted the Arbitration (International Investment Disputes) Act, 1979 (Act No. 39 of 1979); Arbitration (International Investment Disputes) Amendment Act, 2000 (Act No. 52 of 2000) to make the Convention effective in their jurisdiction.
  • Pursuant to Article 13(1) of the ICSID Convention New Zealand has made the following panel designations effective until *21 March 2007; **14 July 2012; ***11 November 2013:
    *Mr. David A.R. WILLIAMS, QC: Practicing Barrister; Former Judge, High Court of New Zealand
    *Sir Kenneth KEITH, KBE: Judge, Court of Appeal of New Zealand; Past President, New Zealand Law Commission
    **Sir Ian BARKER: Former Judge, High Court of New Zealand; Chancellor, University of Auckland
    ***Prof. Campbell Alan McLACHLAN: Professor of Law

New Zealand is a Contracting State to the New York Convention:

  • Date of Accession: 6 January 1983
  • Entry into Force: 6 April 1983
  • New Zealand will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state

In 2007, New Zealand enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as amended in 2006 and is therefore popularly considered to be an UNCITRAL Model Law State
