Guyana Arbitration

Guyana is a Contracting State to the ICSID Convention:

  • Signature: 3 July 1969
  • Deposit of Ratification: 11 July 1969
  • Entry into Force: 10 August 1969
  • On 8 July 1974, Guyana notified ICSID that it would not submit to ICSID jurisdiction in respect of legal disputes arising directly out of an investment relating to the mineral and other natural resources of Guyana. On 29 September 1987, Guyana withdrew that notification stating that "...hereafter the Government of Guyana will, in accordance with Article 25 of the [ICSID] Convention, refer to [ICSID] legal disputes to which that Article applies and which the parties to the dispute consent in writing to submit to [ICSID]."
  • Pursuant to Article 54(2) of the ICSID Convention, Guyana has designated “High Court” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 13(1) of the ICSID Convention Guyana has made the following panel designations effective until *2 August 2013, **17 October 2011:
    *Justice Mohamed SHAHABUDDEEN: Judge, International Criminal Tribunals for Rwanda and for the former Yugoslavia
    **Ms. Janis H. BRENNAN (U.S.A. National): Attorney; Member, International Chamber of Commerce, Commission on Arbitration
