Philippines Arbitration

Philippines is a Contracting State to the ICSID Convention:

  • Signature: 26 September 1978
  • Deposit of Ratification: 17 November 1978
  • Entry into Force: 17 December 1978
  • Pursuant to Article 54(2) of the ICSID Convention, Philippines has designated “The Regional Trial Court of the city or province where the arbitration proceedings were held or where the losing party resides or does business” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 13(1) of the ICSID Convention Philippines has made the following panel designations effective until 16 August 2006:
    - Ms. Lilia BAUTISTA: Assistant Minister, Ministry of Trade and Industry
    - Justice Florentino P. FELICIANO: Member, Appellate Body, World Trade Organization
    - Mr. Efren I. PLANA: Retired Associate Justice, Supreme Court
    - Mr. Armando L. SURATOS: General Counsel, Central Bank of the Philippines

Philippines is a Contracting State to the New York Convention:

  • Signature: 10 June 1958
  • Deposit of Ratification: 6 July 1967
  • Entry into Force: 4 October 1967
  • Philippines will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state & only to differences arising out of legal relationships, whether contractual or not, that are considered commercial under their national law

In 2004, Philippines enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State
