Guatemala is a Contracting State to the ICSID Convention:

  • Signature: 9 November 1995
  • Deposit of Ratification: 21 January 2003
  • Entry into Force: 20 February 2003
  • On 16 January 2003, Guatemala notified ICSID that it "...will require the exhaustion of local remedies as a condition of its consent to arbitration under the [ICSID] Convention." On the same date, Guatemala informed ICSID that it "does not accept submitting to [ICSID] jurisdiction any disputes which arises from a compensation claim against the State for damages due to armed conflicts or civil distrubances."
  • Pursuant to Article 54(2) of the ICSID Convention, Guatemala has designated “Organismo Judicial” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 13(1) of the ICSID Convention Guatemala has made the following panel designations effective until 4 October 2013:

Guatemala is a Contracting State to the New York Convention:

  • Date of Accession: 21 March 1984
  • Entry into Force: 19 June 1984
  • Guatemala will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state & only to differences arising out of legal relationships, whether contractual or not, that are considered commercial under their national law

In 1995, Guatemala enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State

Guatemala is a Contracting State to both the 1899 & 1907 Convention for the Pacific Settlement of International Disputes:
