Kenya Arbitration

Kenya is a Contracting State to the ICSID Convention:

  • Signature: 24 May 1966
  • Deposit of Ratification: 3 January 1967
  • Entry into Force: 2 February 1967
  • As of 20 June 1988, pursuant to Article 25(3) of the ICSID Convention, Kenya designated 2 Constituent Subdivisions/Agencies as competant to be parties to an ICSID arbitration: 1) Kenya Ports Authority; 2) Kenya National Shipping Line 
  • Pursuant to Article 54(2) of the ICSID Convention, Kenya has designated “High Court” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 69 of the ICSID Convention, Kenya enacted The Investment Disputes Convention Act of 1966 (Act 31 of November 22, 1966) to make the Convention effective in their jurisdiction.
  • Pursuant to Article 13(1) of the ICSID Convention Kenya has made the following panel designations effective until 21 July 2002:
    - Mr. Dan K. AMEYO: Advocate
    - Mr. Joseph N.K. ARAP NG’OK: Executive Chairman, Investment Promotion Centre
    - Mr. Peter Wanyaga MUTHOKA: Chief Executive/Secretary, The Export Promotion Council of Kenya
    - Mr. Godfrey Kassim OWANGO, M.B.S.: Chartered Surveyor & Registered Valuer
    - Mr. S.A. WAKO: Advocate

Kenya is a Contracting State to the New York Convention:

  • Date of Accession: 10 February 1989
  • Entry into Force: 11 May 1989
  • Kenya will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state

In 1995, Kenya enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State
