Japan is a Contracting State to the ICSID Convention:

  • Signature: 23 September 1965 
  • Deposit of Ratification: 17 August 1967
  • Entry into Force: 16 September 1967 
  • Pursuant to Article 54(2) of the ICSID Convention, Japan has designated “The summary court or the district court which is designated in the arbitration agreement, and in the case of absence of such designation, the summary court or the district court having the jurisdiction over the place of the defendant’s domicile or residence, or over the place where the subject matter of a claim or the security therefor or any attachable property of the defendant is located” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 13(1) of the ICSID Convention Japan has made the following panel designations effective until 8 September 2014:

Japan is a Contracting State to the New York Convention:

  • Date of Accession: 20 June 1961
  • Entry into Force: 18 September 1961
  • Japan will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state & only to differences arising out of legal relationships, whether contractual or not, that are considered commercial under their national law

In 2003, Japan enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State

Japan is a Contracting State to both the 1899 & 1907 Convention for the Pacific Settlement of International Disputes:
